[EL] Επιχείρηση Scripta Scelera: ανάκληση όλων των μέτρων ασφαλείας, στις 8 Οκτωβρίου η επόμενη ακρόαση της δίκης στη Massa
Μετά από μερικούς μήνες χωρίς τη δημοσίευση συγκεκριμένων ενημερώσεων για την επιχείρηση Scripta Scelera – που προέκυψε στις 8 Αυγούστου 2023, ενάντια στο διεθνιστικό αναρχικό δεκαπενθήμερο περιοδικό «Bezmotivny» – ενημερώνουμε ότι μεταξύ Ιουλίου και Αυγούστου όλα τα εναπομείναντα προληπτικά μέτρα εναντίον οκτώ συντρόφων ανακλήθηκαν. Ας θυμηθούμε εν συντομία ότι ο εισαγγελέας Manotti της DDAA («Περιφερειακή Αντιμαφιόζικη και Αντιτρομοκρατική Διεύθυνση») της Γένοβας είχε ζητήσει δέκα συλλήψεις στη φυλακή για ισάριθμους συντρόφους που συμμετείχαν στη διαδικασία, λαμβάνοντας εννέα ασφαλιστικά μέτρα από τον GIP (προανακριτικός δικαστής): κατ’ οίκον περιορισμός τεσσάρων συντρόφων και υποχρέωση παραμονής στο δήμο κατοικίας με υποχρέωση διανυκτέρευσης στο σπίτι για άλλους πέντε (για έναν, το μέτρο είχε ήδη παύσει στις 29 Μαρτίου λόγω λήξης της προθεσμίας). Κατά τη διάρκεια της επιχείρησης έγιναν επίσης διάφορες επιδεινώσεις μέτρων, συμπεριλαμβανομένων μεταγωγών σε φυλάκιση και κατ’ οίκον περιορισμό, καθώς και τα πιο πρόσφατοι μετριασοί (υποχρέωση παραμονής στον δήμο κατοικίας και υποχρέωση υπογραφής σε τοπικό στρατώνα ή αστυνομικό τμήμα, συνδυασμένα με διάφορους τρόπους).
Με διάταγμα της 10ης Ιουλίου (σε μία περίπτωση κοινοποιήθηκε πάνω από δέκα μέρες μετά) ο GIP του Δικαστηρίου της Γένοβας ανακάλεσε την υποχρέωση υπογραφής για τρεις συντρόφους (ένας ήταν υποχρεωμένος να υπογράφει δύο ημέρες την εβδομάδα, άλλοι δύο είχαν το ίδιο μέτρο αλλά σε καθημερινή βάση) και στη συνέχεια, στις αρχές Αυγούστου, ανακλήθηκε η υποχρέωση υπογραφής δύο μέρες την εβδομάδα για άλλον ένα σύντροφο. Αυτά τα τέσσερα μέτρα είχαν θεσπιστεί από τον GIP τον Μάιο, αντικαθιστώντας τα προηγούμενα (βλ. ‘Operazione Scripta Scelera: aggiornamento sulle misure cautelari e sull’udienza del 24 maggio a Massa’).
Στη συνέχεια, στις 22-23 Αυγούστου, ο δικαστής Garofalo του Δικαστηρίου της Massa διέταξε την ανάκληση της υποχρέωσης παραμονής στο δήμο κατοικίας με την υποχρέωση να υπογράφουν σε καθημερινή βάση οι τέσσερις τελευταίους συντρόφους που εξακολουθούν να υπόκεινται στα μέτρα (σύντροφοι που είναι κατηγορούμενοι σε δίκη με άμεση απόφαση, η οποία βρίσκεται σε εξέλιξη στη Μάσα, για τα άρθρα 414, 270 bis 1 και 278 του ποινικού κώδικα, που ζήτησε ο εισαγγελέας Manotti και ξεκίνησε στις 9 Ιανουαρίου). Μέχρι τις 22-23 Απριλίου βρίσκονταν σε κατ’ οίκον περιορισμό (βλ. ‘Operazione Scripta Scelera: disposto l’obbligo di dimora congiunto all’obbligo di firma per gli inquisiti agli arresti domiciliari restrittivi’).
Λίγα λόγια για την τελευταία ακρόαση και την επόμενη. Στις 25 Ιουνίου, ο Ginepro και ο Casadio του DIGOS («Τμήμα Γενικών Ερευνών και Ειδικών Επιχειρήσεων», πολιτική αστυνομία) της La Spezia έδωσαν αναφορά, με τον πρώτο – όπως επίσης και ο ανώτερος επιθεωρητής Pigoni στην προηγούμενη ακρόαση της 24ης Μαΐου – να επικεντρώνεται στο να αποδώσουν στους συντρόφους τις υπογραφές ή τα ψευδώνυμα που χρησιμοποιούνται στο περιοδικό, καθώς επίσης και το e-mail, και με τον δεύτερο να παρέχει αναφορές για τις θέσεις παρακολούθησης που πραγματοποιήθηκαν κατά τη φάση της έρευνας κοντά στο Circolo Culturale Anarchico «Gogliardo Fiaschi» (ένας αναρχικός χώρος στην Καρράρα, που άνοιξε το 1975), αναφερόμενος επίσης σε μια «υπηρεσία παρατήρησης» για την οποία το DIGOS δεν βρήκε κάποια αναφορά. Ακολούθησε η κατ’ αντιπαράθεση εξέταση από τους συνηγόρους των κατηγορουμένων. Μετά την αναβολή της προγραμματισμένης ακροαματικής διαδικασίας για τις 5 Ιουλίου, η επόμενη ορίζεται για την Τρίτη 8 Οκτωβρίου (15.00, στο δικαστήριο της Massa, piazza De Gasperi).

[EN] Operation Scripta Scelera: all precautionary measures revoked, on October 8 the next hearing of the trial in Massa
After a few months without the publication of specific updates on the Scripta Scelera operation – which arose on August 8th, 2023, against the internationalist anarchist fortnightly ‘Bezmotivny’ – we inform that between July and August all the remaining precautionary measures against eight comrades were revoked. Let us briefly recall that prosecutor Manotti of the DDAA (‘District Anti-Mafia and Anti-Terrorism Directorate’) of Genoa had requested ten prison arrests for as many comrades involved in the proceedings, obtaining nine precautionary measures from the GIP (preliminary investigation judge): restrictive house arrest against four comrades and the obligation to stay in the municipality of domicile with the obligation to stay overnight at home for five others (for one, the measure had already ceased on March 29th due to expiry of the time limit). The operation also saw various aggravations of the measures, including translations to prison and house arrest, as well as the most recent mitigations (in obligation to stay in the municipality of domicile and obligation to sign at local barracks or police station, variously combined).
With an order of July 10th (in one case notified more than ten days later) the GIP of the Court of Genoa revoked the obligation to sign for three comrades (one was under the obligation to sign two days a week, two with the same measure but on a daily basis) and subsequently, at the beginning of August, the obligation to sign two days a week was revoked for another comrade. These four measures had been established by the GIP in May, replacing the previous ones (see the update ‘Operazione Scripta Scelera: aggiornamento sulle misure cautelari e sull’udienza del 24 maggio a Massa’).
Subsequently, on August 22-23rd, judge Garofalo of the Court of Massa ordered the revocation of the obligation to stay in the municipality of domicile with the obligation to sign on a daily basis for the last four comrades still under the measures (the comrades defendants in the trial with immediate judgement ongoing in Massa for articles 414, 270 bis 1 and 278 of penal code, requested by prosecutor Manotti and started on January 9th). Until April 22-23rd they were under restrictive house arrest (see ‘Operazione Scripta Scelera: disposto l’obbligo di dimora congiunto all’obbligo di firma per gli inquisiti agli arresti domiciliari restrittivi’).
A few words about the last hearing and the next one. On June 25th, Ginepro and Casadio of the DIGOS (‘General Investigations and Special Operations Division’, political police) of La Spezia reported, with the first one – like the superior inspector Pigoni in the previous hearing of May 24th – dwelling on the attribution to the comrades of the signatures or pseudonyms used in the fortnightly, as well as of the e-mail, and the second one delivering reports on the surveillance stakeouts carried out during the investigation phase near Circolo Culturale Anarchico ‘Gogliardo Fiaschi’ (an anarchist space in Carrara, opened in 1975), also referring to an ‘observation service’ for which the DIGOS did not find the report. The cross-examination by the defendants’ lawyers followed. After the postponement of the one scheduled for July 5th, the next hearing is set for Tuesday, October 8th (3.00 p.m., at the court of Massa, piazza De Gasperi).

[IT] Operazione Scripta Scelera: revocate tutte le misure cautelari, l’8 ottobre la prossima udienza del processo di Massa
Dopo alcuni mesi senza la pubblicazione di aggiornamenti specifici sull’operazione Scripta Scelera, scattata l’8 agosto 2023 contro il quindicinale anarchico internazionalista “Bezmotivny”, informiamo che tra luglio e agosto sono state revocate tutte le misure cautelari rimanenti nei confronti di otto inquisiti e inquisite. Ricordiamo brevemente che il PM Manotti della DDAA di Genova aveva richiesto dieci arresti in carcere per altrettanti indagati coinvolti nel procedimento, ottenendo dal GIP nove misure cautelari: gli arresti domiciliari restrittivi per quattro e l’obbligo di dimora con rientro notturno per altri cinque (per uno la misura è già cessata il 29 marzo per decorrenza termini). L’operazione ha inoltre visto vari aggravamenti delle misure, tra traduzioni in carcere e arresti domiciliari, così come i più recenti attenuamenti (in obbligo di dimora e di firma, variamente combinati).
Con un provvedimento del 10 luglio (in un caso notificato oltre dieci giorni dopo) il GIP del tribunale di Genova ha disposto la revoca dell’obbligo di firma per tre indagati (uno si trovava all’obbligo di firma due giorni a settimana, due con la stessa misura però a frequenza quotidiana) e successivamente, ai primi di agosto, è stato revocato l’obbligo di firma due giorni a settimana per un’altra indagata. Queste quattro misure erano state stabilite, sostituendo le precedenti, sempre dal GIP a maggio (cfr. “Operazione Scripta Scelera: aggiornamento sulle misure cautelari e sull’udienza del 24 maggio a Massa”).
Successivamente, il 22-23 agosto il giudice Garofalo del tribunale di Massa ha disposto la revoca dell’obbligo di dimora congiunto all’obbligo di firma a frequenza quotidiana per gli ultimi quattro inquisiti ancora con le misure (la compagna e i tre compagni imputati nel processo con giudizio immediato in corso a Massa per gli artt. 414, 270 bis 1 e 278 c. p., richiesto dal PM Manotti e iniziato il 9 gennaio scorso). Fino al 22-23 aprile si trovavano ai domiciliari restrittivi (cfr. “Operazione Scripta Scelera: disposto l’obbligo di dimora congiunto all’obbligo di firma per gli inquisiti agli arresti domiciliari restrittivi”).
Qualche parola sull’ultima udienza e sulla prossima. Il 25 giugno hanno relazionato Ginepro e Casadio della DIGOS di La Spezia, con il primo che – al pari dell’ispettore superiore Pigoni nella precedente udienza del 24 maggio – si è dilungato sull’attribuzione agli indagati delle firme o degli pseudonimi impiegati nel giornale, così come delle caselle di posta elettronica, e il secondo che ha consegnato delle relazioni sugli appostamenti svolti in fase di indagine nei pressi del Circolo Culturale Anarchico “Gogliardo Fiaschi” di Carrara, riferendo anche di un “servizio di osservazione” per cui la DIGOS non ha più reperito la relazione. È seguito il controesame da parte degli avvocati degli imputati. Dopo il rinvio di quella prevista per il 5 luglio, la prossima udienza è fissata per martedì 8 ottobre (ore 15:00, presso il tribunale di Massa, in piazza De Gasperi).

[DE] Operation Scripta Scelera: Aufhebung aller Vorsichtsmaßnahmen, nächste Gerichtsverhandlung im Massa-Prozess am 8. Oktober
Nach einigen Monaten ohne spezifische Aktualisierungen zur Operation Scripta Scelera, die am 8. August 2023 gegen die internationalistische anarchistische Zeitung „Bezmotivny“ eingeleitet wurde, informieren wir hier, dass zwischen Juli und August alle verbleibenden vorsorglichen Maßnahmen gegen acht Verdächtige aufgehoben wurden. Wir erinnern kurz daran, dass Staatsanwalt Manotti von der DDAA [Kreisdirektion für Mafia- und Terrorismusbekämpfung] Genua zehn Haftstrafen für ebenso viele in das Verfahren verwickelte Verdächtige beantragt hatte und neun Vorsichtsmaßnahmen vom Ermittlungsrichter erhielt: restriktiver Hausarrest für vier Personen und die Verpflichtung zur Übernachtung für fünf weitere (für eine Person war die Maßnahme bereits am 29. März wegen Ablaufs der Frist aufgehoben worden). Im Rahmen der Operation kam es auch zu verschiedenen Verschärfungen der Maßnahmen, einschließlich Übertragung ins Gefängnis und in den Hausarrest, sowie zu den jüngsten Abschwächungen (in Form von Aufenthalts- und Unterschriftspflicht, in unterschiedlicher Kombination).
Mit einer Maßnahme vom 10. Juli (in einem Fall mehr als zehn Tage später zugestellt) ordnete der Ermittlungsrichter des Amtsgerichts Genua die Aufhebung der Unterschriftspflicht für drei Verdächtige an (ein Verdächtiger war an zwei Tagen pro Woche zur Unterschrift verpflichtet, zwei weitere mit der gleichen Maßnahme, aber täglich), und Anfang August wurde die Unterschriftspflicht für eine weitere verdächtige Person an zwei Tagen pro Woche aufgehoben. Diese vier Maßnahmen waren im Mai von dem Ermittlungsrichter Genua festgelegt worden und ersetzten die vorherigen Maßnahmen (siehe „Operation Scripta Scelera: Aktueller Stand der vorsorglichen Maßnahmen und Anhörung vom 24. Mai in Massa“).
22. und 23. August ordnete Richter Garofalo des Gerichts von Massa die Aufhebung des Hausarrests und der täglichen Unterschriftspflicht für die letzten vier Angeklagten an, die sich noch unter diesen Maßnahmen befanden (die Genossin und die drei Genossen, die in dem von Staatsanwalt Manotti beantragten und am 9. Januar eingeleiteten Verfahren in Massa wegen der Artikel 414, 270 bis 1 und 278 des Strafgesetzbuchs angeklagt sind). Bis zum 22. und 23. April standen sie unter restriktivem Hausarrest (siehe „Operation Scripta Scelera: die Verpflichtung, zu Hause zu bleiben, und die Verpflichtung, für die unter restriktivem Hausarrest stehenden Angeklagten zu unterschreiben“).
Ein paar Worte zur letzten und zur nächsten Anhörung. Am 25. Juni berichteten Ginepro und Casadio von der DIGOS [Abteilung der italienischen Staatspolizei, die auf politische Repression spezialisiert ist], wobei ersterer – wie auch der Oberinspektor Pigoni in der vorangegangenen Anhörung vom 24. Mai – auf die Zuordnung der in der Zeitung verwendeten Signaturen oder Pseudonyme zu den Verdächtigen einging, sowie der E-Mail-Postfächer, und der zweite lieferte Berichte über die während der Ermittlungsphase in der Nähe des anarchistischen Kulturzentrums „Gogliardo Fiaschi“ in Carrara durchgeführten Beobachtungen, indem er sich ebenfalls auf einen „Observationsdienst“ bezog, für den die DIGOS den Bericht nicht mehr finden konnte. Es folgte das Kreuzverhör durch die Anwälte der Angeklagten. Nachdem die für den 5. Juli angesetzte Anhörung verschoben wurde, ist die nächste Anhörung für Dienstag, den 8. Oktober (15.00 Uhr, im Gericht in Massa, Piazza De Gasperi) angesetzt.

[ES] Operación Scripta Scelera: revocadas todas las medidas cautelares, el 8 de octubre próxima audiencia del juicio en Massa
Tras unos meses sin publicar novedades concretas sobre la operación Scripta Scelera -surgida el 8 de agosto de 2023 contra el quincenario anarquista internacionalista ‘Bezmotivny’– informamos que entre julio y agosto se revocaron todas las medidas cautelares que quedaban contra ocho compañeros. Recordemos brevemente que el fiscal Manotti de la DDAA (‘Dirección Distrital Antimafia y Antiterrorismo’) de Génova había solicitado diez arrestos en prisión para otros tantos compañeros implicados en el proceso, obteniendo del GIP (juez de investigación preliminar) nueve medidas cautelares: arresto domiciliario restrictivo contra cuatro compañeros y la obligación de permanecer en el mismo municipio de su domicilio con la obligación de pernoctar en casa para otros cinco (para uno, la medida ya había cesado el 29 de marzo por expiración del plazo). En la operación también se produjeron diversas agravaciones de las medidas, incluidos traslados a prisión y arresto domiciliario, así como las atenuantes más recientes (en la obligación de permanecer en el mismo municipio del domicilio y la obligación de firmar en el cuartel o comisaría local, combinadas de diversas formas).
Con una orden del 10 de julio (en un caso notificada más de diez días después) el GIP del Tribunal de Génova revocó la obligación de firmar a tres compañeros (uno tenía la obligación de firmar dos días a la semana, dos con la misma medida pero a diario) y posteriormente, a principios de agosto, se revocó la obligación de firmar dos días a la semana a otro compañero. Estas cuatro medidas habían sido establecidas por el GIP en mayo, sustituyendo a las anteriores (véase la actualización «Operazione Scripta Scelera: aggiornamento sulle misure cautelari e sull’udienza del 24 maggio a Massa»).
Posteriormente, el 22-23 de agosto, el juez Garofalo del Tribunal de Massa ordenó la revocación de la obligación de permanecer en el mismo municipio de su domicilio con la obligación de firmar diariamente para los últimos cuatro compañeros que seguían bajo las medidas (los compañeros acusados en el juicio con sentencia inmediata en curso en Massa por los artículos 414, 270 bis 1 y 278 del código penal, solicitado por el fiscal Manotti e iniciado el 9 de enero). Hasta el 22-23 de abril estuvieron bajo arresto domiciliario restrictivo (ver «Operazione Scripta Scelera: disposto l’obbligo di dimora congiunto all’obbligo di firma per gli inquisiti agli arresti domiciliari restrittivi»).
Unas palabras sobre la última audiencia y la próxima. El 25 de junio informaron Ginepro y Casadio de la DIGOS (‘División General de Investigaciones y Operaciones Especiales’, policía política) de La Spezia, el primero -al igual que el inspector superior Pigoni en la audiencia anterior del 24 de mayo- deteniéndose en la atribución a los compañeros de las firmas o seudónimos utilizados en el quincenario, así como del correo electrónico, y el segundo entregando informes sobre las vigilancias efectuadas durante la fase de investigación cerca del Circolo Culturale Anarchico «Gogliardo Fiaschi» (espacio anarquista de Carrara, abierto en 1975), refiriéndose también a un «servicio de observación» del que la DIGOS no encontró el informe. Siguió el contrainterrogatorio de los abogados de los acusados. Tras el aplazamiento de la audiencia prevista para el 5 de julio, la próxima está fijada para el martes 8 de octubre (15:00 horas, en el tribunal de Massa, piazza De Gasperi).
